A trademark or service mark is a word, name, symbol, or device used to identify and distinguish one’s products or services from those provided by other sources. A trade name, however, is the name of the business itself and usually is not trademarked.

Rights in trademarks and service marks are created by proper use of the mark in commerce. A mark can be registered while registration offers important benefits, trademarks do not have to be registered to be protectable and to represent a property right.
